A new type of computer-mediated misdeeds has led to extraordinary development. Crime shifted on Cyberspace has become a global phenomenon and a big challenge for law enforcement agencies.
Two components always play a vital role in every commission of crime, one of which is "mens rea" and second is "Actus Reus". Except in few offences like strict liability in which only either of the two is good enough to make a person liable for commission of a crime. cybercrimes are also a form of crime that needs both actus reus and mensrea but it is very tough and burdensome for a lawyer to prove the presence of the two essentials to constitute a crime before the court. The criminal activities associated with the crime of fraud which do in many different forms through computer or internet, are usually called cyber fraud. Cyber fraud refers to intentional deceit of any kind for unfair or unlawful gain occurring online. Cyber fraud means fraud committed using the Internet instead of traditional pen and paper methods.
“Cyber Crime” defined as any offences where computer network or electronic communications, including any communication device or the Internet or both or more of them are involved and “Cyber law” defined as the legal matters that are related to electronic devices or the cyberspace. It is a great tool to integrate the challenges imposed by perpetrators on the internet with implementation of laws enforce to the physical world. In new era of Internet and computer, cyber laws assume a very vital role. It is significant as it is worried to practically all parts of actions and recreations that occur either on computer or the cyber space.

Cyber forensics is the art and science of applying computer science to aid the legal process. With the rapid advance in technology it quickly became more than just an art though. It is more than the technological, systematic inspection of the computer system and its contents for evidence or supportive evidence of a civil wrong or a criminal act. Computer forensics requires specialized expertise and tools that goes above and beyond the normal data collection and preservation techniques available to end-users or system support personnel. Cyber forensic is primarily concerned with the systematic process of identification seizure, acquisition, authentication, analysis, documentation and preservation of digital evidence.
The Central Forensic Science Laboratory (CFSL) is a wing of the Indian Ministry of Home Affairs, which fulfills the forensic requirements in the country. There are seven central forensic laboratories in India, at Hyderabad, Kolkata, Chandigarh, New Delhi, Guwahati, Bhopal and Pune. CFSL Hyderabad is a centre of excellence in chemical sciences, CFSL Kolkata (the oldest laboratory in India) in biological sciences and CFSL Chandigarh in physical sciences. The CFSL New Delhi comes under the Central Bureau of Investigation, Delhi, whereas the other laboratories are under the control of the Directorate of Forensic Science Services (DFSS) of the Ministry of Home Affairs.
